elementor - v3.18.0 - 20-12-2023 *\/\n.elementor-widget-text-editor.elementor-drop-cap-view-stacked .elementor-drop-cap{background-color:#69727d;color:#fff}.elementor-widget-text-editor.elementor-drop-cap-view-framed .elementor-drop-cap{color:#69727d;border:3px solid;background-color:transparent}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap{margin-top:8px}.elementor-widget-text-editor:not(.elementor-drop-cap-view-default) .elementor-drop-cap-letter{width:1em;height:1em}.elementor-widget-text-editor .elementor-drop-cap{float:left;text-align:center;line-height:1;font-size:50px}.elementor-widget-text-editor .elementor-drop-cap-letter{display:inline-block}<\/style>\t\t\t\t<p><span style=\"font-weight: 400;\">Il 1\u00b0 luglio 2024, la Corte Suprema americana ha adottato la sentenza sul caso inerente alla responsabilit\u00e0 penale dell\u2019ex Presidente Donald Trump per le condotte applicate in seguito alla vittoria elettorale dell\u2019attuale Presidente Biden.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">La sentenza ha stabilito che Trump non pu\u00f2 essere perseguito per azioni che rientravano nei suoi poteri costituzionali, in qualit\u00e0 di Presidente degli Stati Uniti.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Nello specifico, la votazione della Corte ha visto un risultato di sei pareri contro tre.<\/span><\/p><p><span style=\"font-weight: 400;\">Il giudice Roberts ha sostenuto che, in base alla struttura costituzionale americana, che prevede la separazione dei poteri, la natura di quello presidenziale richiede che un ex Presidente abbia una certa immunit\u00e0 da procedimenti penali per atti ufficiali compiuti durante il proprio mandato e in esercizio delle sue funzioni.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Nella decisione presa, leggiamo che l\u2019immunit\u00e0 per gli ex Presidenti \u00e8 \u201cassoluta\u201d rispetto ai loro poteri costituzionali fondamentali ed \u00e8 \u201cpresuntiva\u201d per atti che rientrano nel perimetro esterno della sua responsabilit\u00e0 ufficiale.<\/span><\/p><p><span style=\"font-weight: 400;\">Gli avvocati dell\u2019ex Presidente hanno fatto leva, su questo punto, richiamando l\u2019attivit\u00e0 della Corte Suprema che nel 1982 aveva sospeso le cause civili contro la figura del Presidente per azioni commesse nell\u2019esercizio delle sue funzioni. Questa tradizione giuridica \u00e8 stata, molti diversi anni dopo, richiamata nella causa <\/span><i><span style=\"font-weight: 400;\">Clinton v. Jones <\/span><\/i><span style=\"font-weight: 400;\">del 1997 dove si \u00e8 impedito un\u2019azione legale di questo tipo.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Su quest\u2019ultimo punto, il giudice Roberts ha sottolineato la necessit\u00e0, per un Presidente, di svolgere i doveri del suo ufficio senza paura e in modo equo, senza la minaccia di essere perseguito. A tal proposito, la Corte ha richiamato il precedente offerto dalla sentenza <\/span><i><span style=\"font-weight: 400;\">Nixon v. Fitzgerald <\/span><\/i><span style=\"font-weight: 400;\">(proprio del 1982) dove si sostiene al Presidente \u00e8 affidata una responsabilit\u00e0 di vigilanza e di politica di massima discrezione e sensibilit\u00e0. Invece, per quanto riguarda gli atti non ufficiali, non esiste alcuna forma di immunit\u00e0.\u00a0<\/span><\/p><p><span style=\"font-weight: 400;\">Inoltre, la Corte ha analizzato quattro categorie di condotta contenute nell&#8217;atto di accusa. Le sue discussioni con i funzionari del Dipartimento di Giustizia degli Stati Uniti dopo le elezioni; la sua presunta pressione sull&#8217;allora vicepresidente Mike Pence per bloccare la certificazione del Congresso della vittoria di Biden; il suo presunto ruolo nell&#8217;assemblare falsi elettori pro-Trump da utilizzare nel processo di certificazione e la sua condotta relativa all&#8217;attacco del 6 gennaio 2021 al Campidoglio degli Stati Uniti da parte dei suoi sostenitori.<\/span><\/p><p><span style=\"font-weight: 400;\">I giudici hanno ritenuto che Trump fosse assolutamente immune per le conversazioni con i funzionari del Dipartimento di Giustizia; \u201cpresumibilmente immune\u201d per quanto riguarda gli altri tre punti. La Corte, indirizzandosi verso una presumibile immunit\u00e0, ha rinviato la decisione sul riconoscimento effettivo dell\u2019immunit\u00e0 presidenziale alle Corti di rango inferiore.<\/span><\/p><p><span style=\"font-weight: 400;\">Questa sentenza pu\u00f2 definirsi \u201cstorica\u201d, avendo messo per iscritto, per la prima volta, che gli ex presidenti possono essere
